SUB: The DHFL FD-holders’ team is severely injured by the bodyline bowling of the RBI-appointed CoC:  We need “PAWAR”-Play

Dear Sri Pawar, 

We, the Dewan Housing Finance Corporation Ltd (DHFL, the sponsorer of Mumbai Indians Cricket Team) FD-NCD-holders’ team, are hit by the repeated bouncers by the RBI-appointed Committee of Creditors (CoC) for DHFL under the newly introduced IBC 2016. 

Part-I: CONFESSION OF  VICTIMS OF FINANCIAL ABUSES ⤡

We are the victims of financial abuse that goes against our fundamental human rights. We cannot help ourselves but to reiterate here the three pillars of United Nations Guiding Principles on Business and Human Rights⤡ in the context of the Dewan Housing Finance Corporation Limited (DHFL)’s Resolution Plan. Especially, we are emphasizing on the third pillar in this context, “Access to remedy for victims of business-related abuses”. We are now suffering from anxiety disorders, insomnia and other psychosomatic diseases due to this very reason.

We are gravely injured by the cricket ball faster than 161.3km/h. Our docile bodies have crossed the threshold of our tolerance level. We are crippled⤡ as we possess no de facto helmets, jockstraps/abdominal guards or impact resistant cups, leg pads, elbow guards, gloves, arm guards or chest guards. Moreover, there are no de facto first-aiders and stretcher-bearers, who would take us to the physicians.  When we, the inhabitants of sick society, the victims of DEWAN HOUSING FINANCE CORPORATION LIMITED (DHFL) SCAM⤡, are struggling, during the pandemic, to write this letter to you, our docile bodies are crippled and at the verge of collapsing fully, because of  The collusion among the  BJP, Dawood-Mirchi, and the DHFL VIEW HERE ⤡ (sarcasm intended). The Indian National Congress alleged that Gift BJP Rs 20 cr, get ‘return gift’ worth Rs 31K cr: Congress on fraud by DHFL VIEW HERE ⤡ (As reported on 30 January, 2019, ©Millennium Post).

The situation is bleak and we are living within a sick society. (cf. India Wounded: A Bird’s Eye View VIEW HERE ⤡)!  A guru and a tycoon feel India’s endless bank salvage pain VIEW HERE ⤡ (As reported on Jan 13, 2021 © The Economic Times).  The cronies are working against the common persons.

Why are there so much bouncers per over? The International Cricket Council (ICC) introduced a “two bouncers per over per batsman”, with a “two-run no-ball penalty” if the bowler exceeded two bouncers an over. Now who will bell the cat? Who will penalize? The umpires are busy with their itching palms (Rs. 1 Crore+ for them!)—they are not looking at the bowler’s step, who is overstepping the crease. We are not only wounded by the short pitch balls, repeated Larwoodian bodyline bowling with no balls that are ignored by the vigilant umpires (or emperors), our three stumps have also been completely knocked out. 

We are impelled to play test match series one after another without any breathing-spaces. There is no question of T20-Twenty or even one-day match. 21 CoC meetings/test matches are over within the last 22 months. We are going to be vanquished or simply extinguished—just waiting for the third umpire’s politically appropriated, approximated, pre-codified and pre-determined decisions.

We are also sceptic about the role of the RBI-appointed COC for the DHFL. According to our perception, the DHFL is deliberately handed over to a father of a damad of a favoured tycoon in a throw away prices following the ritual of crony capitalism. Therefore, we are smelling the rat in the DHFL-COC Resolution Process⤡, especially in case of diligent auditing (we are working on it. Since we, the DHFL-FD-holders’ team, are always compelled to play the last innings of the match, we have to follow the ascribed rules and regulations of the Duckworth–Lewis–Stern method (DLS) ⤡  or IBC⤡, NHB Act ⤡, Companies Act⤡, RBI Act⤡  in our rainy days. We are running out—time is also running out fast. That is our halting point: world-wide catastrophic pandemic (with inflation due to contraction of GDP by 24% in April to June, 2020). Our target has increased, though we, the DHFL-FD-NCD-holders’ team, do not know the rationale of such logico-mathematics of such legal provisions.

Alas! We, the DHFL-FD-NCD-holders’ team, are not united in solidarity. We are sledging our own players; we do not really believe in each other as some people are fishing in the troubled waters. 

We, the DHFL-FD-holders’ team, are appealing to you to kindly rescue us from such catastrophic state-of-affairs by regulating the regulatory authorities with reference to the DHFL scam.

According to our common sense, we have understood that it is a case of daylight looting of an ongoing, solvent company by depriving all the public investors that include FD and NCD Holders. 

Part-II: FROM THE GRASSROOTS TO THE CORRIDORS OF PAWAR⤡

Though strains, sprains, fractures, bruising and open wounds, we are fighting back in the second innings of our batting of this lengthy test match series (21 meeting RBI-appointed CoC have held so far). As players from the grassroots, we are trying our best to play safe grass-cutting shots to reach the corridors of PAWAR.

We are too thirsty, but there is water nowhere—not even a drop to drink. We are suffering from severe dehydration.

However, the intelligent Power of PAWAR rescues us. The man, who is instrumental in building percolation tanks and introduces rain water harvesting during severe drought, rescues us with the ORS. He added sugar to our water from his mills after directly processing it at his sugarcane agricultural farm. 

We, the victims of the DHFL Scam, are now within the ruling party-made drought—drought of money! To quench our thirst, we are taking our recourse to the Power of PAWAR. Water is available, but who else will give us except the corridors of PAWAR?

So, in the last innings, despite being injured, we have won the simulated and crafted match with the help of injured spinners. 

All the opponent players cannot face the googlies…they are on the back feet…their bats hit their own wickets. Their way of playing is suicidal.

We think that our rainy days will end in this way with a rainbow in the sky.

Hoping for a Rainbow Coalition for dismantling the sceptre of plutocracy. We think that we will be emPAWARed And The Glory VIEW HERE ⤡ (As reported on 29^th July, 2013 ©India Today) of victory in one fine morning with clear sky with the rainbow.
